Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

Retention

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see the ‘Your rights’ section below.

Creator Gifting Program

Separately from purchases made through the Site, we run a creator gifting programme in which we contact social media creators to offer a product in exchange for an honest review. This section describes the Personal Information involved, and applies in addition to the rest of this policy.

Personal Information collected: name or display name, Instagram and TikTok handles, business email address, follower counts, subject area, and where we found the creator; the content, date and channel of messages exchanged between us and the creator by email, Instagram or TikTok; and the status of the conversation, including whether a gift was offered, claimed and delivered.

Purpose of collection: to invite creators to take part in the programme, to answer their replies, to send and deliver a gift, and to keep an accurate record of a conversation already under way so that it is handled properly and so that we do not contact someone who has asked us not to.

Source of collection: collected from the creator's publicly available social media profile and from public creator directories, and directly from the creator when they reply to us.

Disclosure for a business purpose: shared with our service providers, including Google Workspace, which hosts our records, Meta, through which Instagram messages are exchanged, SocialSnowball, which administers the gifting and affiliate arrangements, and Shopify, which fulfils the gift order.

Instagram and Meta

We operate an Instagram professional account, and we use Meta's Instagram Platform to read the direct messages sent to our own account, so that a reply from a creator reaches the person handling the conversation rather than going unnoticed. Through Meta's platform we receive the Instagram username and account identifier of the person messaging us, the text and timestamp of the messages in those conversations, and a message identifier we use to avoid recording the same message twice.

We use this information only to record and answer that conversation. We do not use Instagram messaging data for advertising, we do not sell it, we do not combine it with other sources to build profiles, and we do not use it to train machine learning models. Our access is limited to the inbox of our own business account; we cannot and do not read anyone else's messages. Meta's own handling of your information is governed by the Meta Privacy Policy.

Every message we send to a creator is written and sent by a person. We do not send messages automatically.

Retention of creator information

We retain Personal Information collected through the creator gifting programme while the conversation is active and for twenty-four months after the last contact, so that we can honour an arrangement already made and avoid contacting a creator who has already declined, unless and until you ask us to erase this information. Where a creator has asked not to be contacted, we retain a record of that request indefinitely, because deleting it would mean contacting them again.

Deleting your creator programme information

If we have contacted you about the creator gifting programme, you may ask us to delete the information we hold about you. You do not need an account with us and you do not need to give a reason.

Email us at support@theatomicbear.com with the subject line Delete my data, including whichever of these you have: the Instagram or TikTok handle we contacted you on, or the email address we wrote to. Replying to any message we have sent you with the words "delete my data" has the same effect.

We will confirm receipt within three business days and complete the deletion within thirty days, then email you to confirm it is done. We will delete your name and handles, your email address, the profile details we recorded, the content of the messages between us, and the status of the conversation.

We will retain one record: a note that you have asked not to be contacted, and the handle or address to which it applies. We keep this in your interest, because without it nothing prevents us from finding your public profile again and beginning the conversation afresh. If you would prefer that we delete this as well, say so in your email and we will, on the understanding that we may contact you again in future.

If you messaged us on Instagram, Meta retains its own copy of that conversation independently of us, and deleting our records does not remove it from Instagram. You may delete the conversation in the Instagram app, and you may remove our access at any time under Settings, then Website permissions, then Apps and websites.

Cookies

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use the website, for instance whether it’s their first time visiting or if they are a frequent visitor.
